Illegal Dumping Felony Charge in The Woodlands

THE WOODLANDS, Texas – A Houston man is facing serious charges after being apprehended for allegedly dumping trash from a U-Haul truck into a commercial dumpster in The Woodlands, marking his third reported offense. John Thomas, 53, was arrested on May 23rd and charged with a State Jail Felony for illegal dumping, a crime that carries significant penalties in Texas.

The investigation began on May 18th when Montgomery County Precinct 3 Constable’s Deputy S. Smith was on routine patrol near the intersection of Research Forest Drive and I-45. Deputy Smith observed a U-Haul truck actively discarding waste into a commercial dumpster. The deputy promptly recorded the vehicle’s identifying details, setting the stage for a subsequent investigation.

Following the initial observation, investigators revisited the scene. Their efforts yielded crucial evidence, including documents bearing Thomas’s name found amongst the illegally dumped materials. Further corroboration came from surveillance footage obtained from the area, which reportedly captured the incident and solidified the case against Thomas. It was also revealed during the investigation that Thomas had received two previous warnings for illegal dumping, underscoring a pattern of disregard for waste disposal regulations.

A State Jail Felony charge for illegal dumping in Texas, typically applied when the quantity of waste exceeds 200 pounds or 200 cubic feet, or in cases of repeat offenses, carries severe legal consequences. If convicted, Thomas could face a prison sentence ranging from 180 days to two years in a state jail facility, in addition to a fine of up to $10,000. These penalties are outlined under the Texas Health and Safety Code, specifically regarding the unlawful disposal of solid waste.

Constable Ryan Gable’s office emphasized its unwavering commitment to environmental protection and upholding local ordinances. “Illegal dumping is not just an eyesore; it poses serious environmental and public health risks to our community,” stated a representative from Constable Gable’s office. “We are dedicated to maintaining the cleanliness and integrity of Montgomery County, and those who choose to violate these laws will be held accountable.”

Illegal dumping incidents detract from the aesthetic quality of the community, create potential hazards, and burden taxpayers with cleanup costs. Authorities continue to encourage residents to report any suspicious activities related to illegal dumping to help preserve the county’s natural resources and urban spaces.

Thomas is currently awaiting arraignment and further legal proceedings. Details regarding his bond or next court appearance were not immediately available.
